    About Henry County Excess Funds

    When a property in Henry County is sold at a tax sale for more than the delinquent taxes, penalties, interest, and costs owed, the leftover money is called excess funds (also referred to as surplus funds, tax sale overage, or excess proceeds). The Henry County Tax Commissioner holds these funds until a valid claim is filed and approved.

    Excess funds typically belong, in order of priority, to the former property owner, heirs of a deceased owner, and other parties with a recorded interest in the property at the time of the tax sale, such as mortgage holders or lienholders.

    How to File a Claim

When competing claims are filed, or when ownership is unclear, the Tax Commissioner may file an interpleader action in Superior Court and let a judge decide who is entitled to the money.
