When a property in Pickens County is sold at a tax sale for more than the delinquent taxes, penalties, interest, and costs owed, the leftover money is called excess funds (also referred to as surplus funds, tax sale overage, or excess proceeds). The Pickens County Tax Commissioner holds these funds until a valid claim is filed and approved.
Excess funds typically belong, in order of priority, to the former property owner, heirs of a deceased owner, and other parties with a recorded interest in the property at the time of the tax sale, such as mortgage holders or lienholders.
Claims for Pickens County excess funds must be made in writing to the Tax Commissioner and supported by proof of identity and proof of interest in the property. When competing claims are filed, or when ownership is unclear, the Tax Commissioner may file an interpleader action in Superior Court and let a judge decide who is entitled to the money.
